Landlord and tenant - Landlords and Tenants Residential Tenancies Act (2004)

Under this new Legislation, which came into operation on 1st September, 2004, further changes have now been introduced to the private rental sector. These include:-

(a) By the 30th November, 2004 all tenancies must be reg istered with the Private Residential Tenancies Board.

(b) The Registration Fee is €70.00 A total fee of €300.00 is payable by a Landlord registering a number of tenancies in the one building. Severe fines are imposed for late Registrationn and refusal to register.

(c) A Landlord is not entitled to a rent greater than teh Market Rent and may only have one rent review per year (unless there are substantial changes in the accommodation).

(d) If a Tenancy has existed for 6 months a Landlord cannot terminate it within the following 31/2 years unless on specific grounds as set out in the Act.

(e) Termination notice varies for both Landlord and Tenant depending on the length of occupation.
